Subject is murder BRIG MALLBY. Following consideration of eye witness account by CAPT LAUGHLAND HQ 49 BDE. Witness left BDE HQ with CAPT SMITH between 1600 and 1630 hrs 30 OCT and joined BRIG MALLABY CAPT SHAW FSS and INDONESIAN leaders at Government Building. Whole party then went to International Bank Building where D COY 6 MAHRATTAS were. On partys arrival no fighting was in progress. INDONESIAN leaders began explaining GEN HAWTHORNS agreement to crowd. This well received except by one man who later quietened and went away. Party then started for drawbridge area whence firing heard thinking all was quiet. Party stopped by crowd in 300 yds. INDONESIAN leaders harangued crowd but one man inflamed crowd witness SHAW and SMITH certain he was JAPANESE and leaders lost control. Crowd demanded MAHRATTAS come out without arms leaving arms under guard of TKR. MALLABY refused believing own tps would be massacred despite assurances safe conduct. By this time MALLABYS party despaired of getting away. At 1700 hrs MALLABY agreed to order MAHRATTAS out. Crowd took SHAW to convey order. At this time all three Officers in back seat INDONESIAN Police car. MALLABY near side then witness then SMITH. Witness hid grenade undetected when crowd disarmed party. Later one INDONESIAN leader returned saying MAHRATTAS would be out in 5 minutes. Soon after firing broke out both sides and Officers dived in bottom of car. One man fired four shots into car but hit no one. Officers remained same position about 2 hours while firing continued. Later crowd dispersed except 2 men who tried move car. One man then touched MALLABY. MALLABY spoke to him and asked to be taken to SOEDIRMAN SOEKARNO or other INDONESIAN leaders explaining that car was police car and he had come to stop fighting. Men nonplussed and moved away later returning. MALLABY repeated his request. Without any warning one man then fired revolver at MALLABY and killed him. Time of death 1930 to 1945 hrs 30 OCT. After this shot men ducked behind car as firing had broken out again. By now witness had given grenade to SMITH. Men knew witness was alive and fired revolver through window at him. SMITH simultaneously threw grenade. After explosion witness and SMITH ran for canal 20 yards distant. No firing aimed at them on way to canal. Both Officers escaped and made way to docks. Finally reached own tps approx. 2300 hrs.
